Terms of service

These terms govern the use of the Zayapa mobile app and the zayapa.com website (together, "the service"), operated from Ecuador. By creating an account or using the app, you accept these terms. If you do not agree, do not use the service.

This English version is a courtesy translation. If anything differs, the Spanish version prevails.

01What Zayapa is

Zayapa is an independent travel guide to the Galápagos Islands: maps, visitor site information, an itinerary generator, a wildlife log, and planning tools. Zayapa is not a travel agency or a tour operator: we do not sell tours, tickets, or lodging, and we do not broker bookings.

02Your account

  • You can use the app as a guest, or create an account with your email or with Google.
  • You are responsible for keeping your sign-in confidential and for the activity on your account.
  • You must be at least 13 years old to create an account.
  • You can delete your account at any time from Settings (see the privacy policy).

03License

We grant you a personal, non-exclusive, non-transferable license to use the app on your devices. You may not copy, modify, distribute, resell, or reverse-engineer the app or its content (texts, pixel art illustrations, curated data), which belong to Zayapa or its licensors. Maps use OpenStreetMap data under its own license (ODbL).

04Purchases

The app offers a premium unlock as a one-time payment processed by Google Play or the App Store — we do not sell subscriptions. Refunds are governed by the policies of the store where you bought it. Prices may change, but a price change never affects what you already bought.

05Content you create

Your sightings, itineraries, notes, and other content belong to you. You give us permission only to store them and show them to you (and to anyone you choose to share them with). Do not post content that is illegal, offensive, or infringes third-party rights; we may remove it if we detect it.

06Use of travel information

The information in the app (schedules, prices, trail conditions, guide requirements, travel times) is curated with resident judgment, but can change without notice: weather, Galápagos National Park decisions, local operators. Verify on site anything critical to your safety or your wallet.

  • Outdoor activities (hiking, snorkeling, diving, boat travel) are done at your own risk and judgment.
  • Always follow the rules of the Galápagos National Park: marked trails, distance from wildlife, mandatory guides where required.
  • Generated itineraries are planning suggestions, not professional advice.

07Limitation of liability

The service is provided "as is" and "as available". To the maximum extent permitted by law, Zayapa is not liable for indirect damages arising from the use of the service, from inaccuracies in the information, or from interruptions. Nothing in these terms limits rights that Ecuadorian law, or the law of your country of residence, grants you as a consumer and that cannot be waived.

08Termination

You can stop using the service whenever you want. We may suspend or close accounts that violate these terms or abuse the service (for example, mass data extraction).

09Changes to these terms

If we make substantial changes, we will announce them in the app with reasonable notice. The current version will always be at zayapa.com/terminos (Spanish) and zayapa.com/en/terms (English).

10Governing law and contact

These terms are governed by the laws of the Republic of Ecuador. Any dispute will be submitted to the competent courts of Ecuador, without prejudice to the consumer protection rules of your country of residence. Questions: info@zayapa.com.
